Удосконалення механізмів взаємодії органів публічної влади та інститутів громадянського суспільства

Abstract

В статті розглянуто роль та значення громадянського суспільства у становленні сучасної моделі українського суспільства. Метою статті є аналіз процесів розвитку громадянського суспільства в Україні, формулювання пропозицій і рекомендацій щодо удосконалення механізмів взаємодії органів публічної влади та інститутів громадянського суспільства. Зазначено, що основним завданням є пошук оптимального, гармонійного співвідношення участі держави у суспільних справах зі створенням комплексу таких механізмів взаємодії влади та суспільства, які б не перешкоджали, а сприяли розвитку громадянського суспільства. Запропоновано під громадянським суспільством розуміти специфічне та високоорганізоване об’єднання громадян, яке має високі економічні, соціальні, політичні та морально-культурні цінності, де на основі правових норм реалізуються відповідні обов’язки громадян, а держава виступає гарантом цих прав. Констатовано, що метою взаємодії є підвищення якості життя, забезпечення сталого розвитку соціальних відносин та вирішення соціальних проблем, яке здійснюється у рамках законодавства на взаємовигідній основі та яке включає інформування громадян про діяльність об’єднань та влади, сприяння участі громадян при розробці, обговоренні та прийнятті державно-управлінських рішень, їх контроль та реалізацію. Виділено такі основні види взаємодії: залучення інститутів громадянського суспільства до консультацій та прийняття владно-управлінських рішень; громадський контроль за діяльністю органів виконавчої влади; інформаційна публічність, відкритість та прозорість; спільна реалізація соціально важливих програм. Основними засадами взаємодії державних органів та інститутів громадянського суспільства запропоновано визначати: визнання органами державної влади прав та законних інтересів інститутів громадянського суспільства на участь у формуванні та реалізації державної політики; забезпечення органами державної влади прав та законних інтересів інститутів громадянського суспільства; невтручання органів державної влади у діяльність один одного, за винятком випадків, передбачених чинним законодавством; гласність та колегіальність при виробленні спільних рішень та їх реалізації; відповідальністьзавиконаннявзятихнасебезобов’язань; рівність прав інститутів громадянського суспільства на державну підтримку у випадках, передбачених чинним законодавством; державний контроль за діяльністю інститутів громадянського суспільства, у тому числі за використанням коштів державного бюджету; громадський контроль за органами державної влади відповідно до чинного законодавства. Рекомендовано з метою удосконалення функціонування діючого механізму взаємодії громадянського суспільства та влади здійснення наступних заходів: організація періодичних соціологічних опитувань населення щодо виявлення наявних проблем; щорічна звітність керівників державної та муніципальної влади перед громадянами; регулярні телеконференції на місцевих та державних каналах у ЗМІ; використання можливостей мережі Інтернет з метою налагодження зворотного зв’язку; проведення круглих столів за участю представників державних та місцевих органів влади і населення. The article examines the role and significance of civil society in the formation of the modern model of Ukrainian society. The purpose of the article is to analyze the processes of development of civil society in Ukraine, to formulate proposals and recommendations for improving the mechanisms of interaction between public authorities and civil society institutions. It is noted that the main task is to find an optimal, harmonious ratio of state participation in public affairs with the creation of a complex of such mechanisms of interaction between the government and society, which would not hinder, but promote the development of civil society. It is suggested that civil society should be understood as a specific and highly organized association of citizens, which has high economic, social, political and moral and cultural values, where on the basis of legal norms, the corresponding duties of citizens are implemented, and the state acts as a guarantor of these rights. It was established that the purpose of interaction is to improve the quality of life, ensure the sustainable development of social relations and solve social problems, which is carried out within the framework of legislation on a mutually beneficial basis and which includes informing citizens about the activities of associations and authorities, promoting the participation of citizens in the development, discussion and adoption state management decisions, their control and implementation. The following main types of interaction are highlighted: the involvement of civil society institutions in consultations and the adoption of power-management decisions; public control over the activities of executive authorities; information publicity, openness and transparency; joint implementation of socially important programs. The main principles of interaction between state bodies and institutions of civil society are proposed to be defined as: recognition by state authorities of the rights and legitimate interests of civil society institutions to participate in the formation and implementation of state policy; ensuring the rights and legitimate interests of civil society institutions by state authorities; non-interference of state authorities in each other’s activities, with the exception of cases provided for by current legislation; transparency and collegiality in the development of joint decisions and their implementation; responsibility for the fulfillment of assumed obligations; equal rights of civil society institutions to state support in cases provided for by current legislation; state control over the activities of civil society institutions, including the use of state budget funds; public control over state authorities in accordance with current legislation. In order to improve the functioning of the existing mechanism of interaction between civil society and the authorities, it is recommended to implement the following measures: organization of periodic sociological surveys of the population to identify existing problems; annual reporting of heads of state and municipal authorities to citizens; regular teleconferences on local and state media channels; using Internet capabilities to establish feedback; holding round tables with the participation of representatives of state and local authorities and the population.
