Досвід формування правового механізму публічного управління у сфері охорони торговельних марок в країнах Європи : проблеми та перспективи його впровадження в Україні

Abstract

Статтю присвячено аналізу європейського досвіду формування правового механізму публічного управління у сфері охорони та захисту торговельних марок. Зокрема, вивчено та проаналізовано особливості правової охорони торговельних марок в Італії, Португалії, Швейцарії, Франції та інших країнах Європейського Союзу. Окрему увагу приділено питанню охорони територіальних марок та їх співвідношенню з добре відомими марками. Визначено, що формування європейських стандартів щодо охорони та захисту торговельних марок у Європейському Союзі було зумовлене процесами глобалізації та інтеграції. В статті звертається увага на необхідність подальшої підготовки України до членства в Європейському Союзі шляхом завершення всеосяжної трансформації всіх сфер. Однією з таких сфер є сфера інтелектуальної власності, зокрема, але не виключно, щодо питань правової охорони та захисту торговельних марок. Трансформація сфери правової охорони та захисту об’єктів інтелектуальної власності є важливим та необхідним елементом вільного обміну товарами та послугами та економічного розвитку й процвітання України. Автором на основі проведеного дослідження визначено основні напрямки, розвиток яких, дозволить підвищити рівень правової охорони та захисту торговельних марок в Україні за рахунок удосконалення правового механізму державного управління в сфері інтелектуальної власності. Встановлено, що подальше удосконалення законодавчого клімату в сфері інтелектуальної власності в Україні є необхідною умовою для її міжнародної інтеграції. The article is devoted to the analysis of the European experience in the formation of the legal mechanism of public administration in the field of protection and protection of trademarks. In particular, the peculiarities of legal protection of trademarks in Italy, Portugal, Switzerland, France and other countries of the European Union were studied and analyzed. Particular attention is paid to the protection of territorial marks and their correlation with well-known marks. It was determined that the formation of European standards for the protection and protection of trademarks in the European Union was determined by the processes of globalization and integration. The article draws attention to the need to further prepare Ukraine for membership in the European Union by completing a comprehensive transformation of all spheres. One of these areas is the sphere of intellectual property, in particular, but not exclusively, in relation to issues of legal protection and protection of trademarks. The transformation of the sphere of legal protection and protection of intellectual property objects is an important and necessary element of the free exchange of goods and services and the economic development and prosperity of Ukraine. Based on the conducted research, the author identified the main directions, the development of which will allow to increase the level of legal protection and protection of trademarks in Ukraine due to the improvement of the legal mechanism of state management in the field of intellectual property. It has been established that the further improvement of the legislative climate in the field of intellectual property in Ukraine is a necessary condition for its international integration.
