Історичні передумови демократичних змін в контексті формування та розвитку української державності

Abstract

У статті досліджуються демократичні витоки суспільно-державного устрою у різні історичні періоди. Розглянуто важливі державотворчі правові джерела: Магдебурзьке право, Литовські статути, Конституція Пилипа Орлика, які мали визначальний вплив на створення засад республіканської демократичної правової держави. З’ясовано порядок виникнення, прийняття привілеїв Магдебурзького права містами України. Виявлено демократичні засади державного та місцевого устрою у різні періоди від часів Київської Русі, Великого князівства Литовського, до Козацької держави. Розглянуто особливості адміністративно-територіального устрою за часів перебування українських земель у складі Російської іперії, а також централізований устрій радянського періоду. Визначено роль громадівського самоврядування як первинної ланки місцевого управління , процесу зміни влади як підгрунтя демократії. Доведено, що Українська державність має демократичні основи та корені у тому числі, через вплив західного політико-правового простору. У зв’язку з цим, системні зміни, особливо на рівні місцевого управління мають на меті повернення та відродження втрачених демократичних коренів та побудови розвинутої системи місцевого управління. The article examines the democratic origins of the social and state system in diff erent historical periods. Important state-building legal sources are considered: Magdeburg law, Lithuanian statutes, the Constitution of Philip Orlyk, which had a decisive infl uence on the establishment of the foundations of the republican democratic state governed by the rule of law. The order of origin and acceptance of the privileges of the Magdeburg law by the cities of Ukraine is clarifi ed. The democratic principles of the state and local system in diff erent periods from the times of Kievan Rus, the Grand Duchy of Lithuania, to the Cossack state were revealed. The peculiarities of the administrativeterritorial system during the stay of the Ukrainian lands as part of the Russian Empire, as well as the centralized system of the Soviet period, are considered. The role of civic self-government as the basis of local government, the process of change of power as the basis of democracy is defi ned. It is proved that Ukrainian statehood has democratic foundations and roots, including due to the infl uence of the Western political and legal space. In this regard, systemic changes, especially at the local government level, are aimed at restoring and reviving lost democratic roots and building a developed local government system.
