Теоретичні аспекти захисту честі, гідності та ділової репутації публічних осіб

Abstract

Необхідність у поглибленому дослідженні змісту понять "публічна особа", "честь", "гідність", "ділова репутація", "захист честі, гідності та ділової репутації", "поширення інформації", "недостовірна інформація", "фактичне твердження", "оціночне судження" у контексті публічного управління та адміністрування стала метою написання статті. Задля того, щоб розкрити сутність проблематики питання захисту честі, гідності та ділової репутації публічної особи в Україні, необхідно розуміти що саме має на увазі українське законодавство, наукова та міжнародна спільнота під вищезазначеними поняттями, оскільки самі по собі визначення не дають всестороннього розуміння сутності цих явищ. Необхідність розуміння теоретичного, наукового визначення зазначених понять являють собою обов'язковий підготовчий матеріал щодо подальшого його практичного використання зацікавленими особами у справах захисту честі, гідності та ділової репутації публічних осіб на території України. This article deals with the problems of protection of honor, dignity and business reputation of a public person. Particular attention is given to need understanding the theoretical definition "public person", "honor", "dignity", "business reputation", "dissemination of information" and "inaccurate information" in relation to public persons on the territory of Ukraine. The study established that theoretical material, it is determined that political public persons can be called persons engaged in political activities and perform public functions in Ukraine. In turn, public servants are persons engaged in activities in local self-government, judicial and state authorities, prosecutor's office, military service, other official activities in state bodies or hold public positions and/or have the right to dispose of state resources. It is investigated that the main sign of the above terms is the presence of public interest and the influence of a person on public life. In the context of public administration, scientists propose to consider public servants a public person, under the following conditions: significant social functions, popularity among society through their own activities. It is determined that the list of national public figures is much wider than the list of foreign public figures in accordance with the current legislation of Ukraine. The conclusion dwells upon the need for the mandatory presence of the composition of the offense, the main condition of which is the "dissemination of inaccurate information", and not the statement of "assessment judgment". The "dissemination of false information" should be understood as the proof of information that does not correspond to reality or is presented falsely to an indefinite circle of persons by means of information transmission (Internet, media, etc.). Instead, the category of "value judgment" is not refutable, since these are statements that do not contain evidence such as criticism or assessment of actions. Whether "controversial information" is exactly unreliable is decided by the court in each individual case. This problem is underexplored and requires further research is the analysis of Ukrainian judicial practice in cases of protection of honor, dignity and business reputation of public persons in the context of public administration.
