Протидія корупції в публічних закупівлях під час воєнного стану

Abstract

У статті досліджено вплив корупції при публічних закупівлях у сфері оборони. Публічні закупівлі розглядаються як придбання замовником товарів, робіт і послуг у порядку, встановленому Законом України "Про публічні закупівлі" та з врахуванням постанови Кабінету Міністрів України від 12.10.2022 № 1178 "Про затвердження особливостей здійснення публічних закупівель товарів, робіт і послуг для замовників, передбачених Законом України "Про публічні закупівлі", на період дії правового режиму воєнного стану в Україні та протягом 90 днів з дня його припинення або скасування". Визначено, які існують корупційні ризики та їхній негативний вплив на оборонний сектор країни. Корумповані і неефективні збройні сили знижують рівень суспільної довіри до державних інституцій та є безпосередньою загрозою безпеці країни та її громадянам. Визначено, що на законодавчому рівні під час воєнного стану система публічних закупівель зазнала значних змін. Процедура передбачає скорочення строків проведення повноцінних тендерів у Prozorro, що дозволить замовникам проходити закупівлі вдвічі швидше, ніж раніше. Проаналізовано якісний склад корупційної злочинності у сфері військової безпеки. Досліджено роботу системи Prozorro під час введення воєнного стану, яка безпосередньо покликана забезпечувати прозорість закупівель у сфері оборони. Проаналізовано механізми удосконалення процедури оборонних закупівель під час воєнного стану. Запропоновано напрямки подолання корупційних загроз, які сприятимуть збереженню суверенітету, територіальної цілісності, демократичного конституційного ладу та реалізації інших національні інтереси України. The article examines the influence of corruption in public procurement in the field of defense. Public procurement is considered as the purchase of goods, works and services by the customer in accordance with the procedure established by the Law of Ukraine "On Public Procurement" and taking into account the Resolution of the Cabinet of Ministers of Ukraine dated 12.10.2022 No. 1178 "On approval of the specifics of public procurement of goods, works and services for customers, provided by the Law of Ukraine "On Public Procurement", for the period of the legal regime of martial law in Ukraine and within 90 days from the day of its termination or cancellation". It was determined what corruption risks exist and their negative impact on the country's defense sector. Corrupt and ineffective armed forces reduce the level of public trust in state institutions and are a direct threat to the security of the country and its citizens. It was determined that the public procurement system underwent significant changes at the legislative level during the martial law. The procedure provides for shortening the terms of conducting full-fledged tenders in Prozorro (an electronic public procurement system, which is an online platform where state and utility customers announce tenders for the purchase of goods, works and services, and business representatives compete at auctions for the opportunity to supply it to the state), which will allow customers to go through purchases twice as fast as before. The qualitative composition of corruption crimes in the field of military security is analyzed. The operation of the Prozorro system during the introduction of martial law, which is directly designed to ensure transparency in defense procurement, was studied. Mechanisms for improving the defense procurement procedure during martial law are analyzed. Directions for overcoming corruption threats are proposed, which will contribute to the preservation of sovereignty, territorial integrity, the democratic constitutional system and the realization of other national interests of Ukraine.
