Організаційно-правове забезпечення функціонування системи управління у сфері безпеки та охорони державного кордону

Abstract

У статті наголошено, що враховуючи реалії сучасного світу, постає питання пошуку нових ідей та оптимальних рішень для розвитку системи управління у сфері охорони та захисту державних кордонів в межах багатовимірного комунікаційного простору із обов'язковим залученням різних суб'єктів міжнародних відносин, а також розроблення ефективних доктрин, концепцій, стратегій та програм з метою формування та вдосконалення механізмів реалізації державної політики у сфері безпеки державних кордонів. Автором зазначено, що внаслідок "умовного" територіального розмежування колишніх радянських республік Україна фактично опинилася відкритою для безконтрольного пересування через державний кордон громадян, незаконного вивезення товарів і вантажів, переміщення зброї, вибухових і отруйних речовин, наркотичних засобів та іншої контрабанди. Проаналізовано систему суб'єктів сектору безпеки і оборони, що відповідають за забезпечення безпеки та охорони державного кордону України. The article states that the need to ensure the functioning of the management system in the field of security and border protection is a natural need for territorial delimitation between countries through the establishment of state borders, as well as ensuring state sovereignty within the state. It is emphasized that given the current realities of the rapidly changing world, the question of finding new ideas and optimal solutions for the development of management in the field of protection and protection of state borders within a multidimensional communication space with the involvement of various actors in international relations and development of effective doctrines, concepts, strategies and programs in order to form and improve mechanisms for implementing state policy in the field of state border security. The author notes that due to the "conditional" territorial delimitation of the former Soviet republics, Ukraine was effectively open to uncontrolled movement of citizens across the state border, illegal export of goods and cargo, movement of weapons, explosives, drugs and other contraband, as well as smuggling. Ukraine's environmentally hazardous waste production, intensified the activities of criminal and extremist groups on the state border. It is proved that the Ministry of Internal Affairs of Ukraine is the relevant ministry, whose role is to create conditions for the development of a safe living environment as a basis for security in Ukraine, as well as ensuring the functioning of the security and border management system. However, the State Border Guard Service of Ukraine is a special law enforcement body that implements state policy in the field of security of the state border of Ukraine and protection of sovereign rights of Ukraine in its exclusive (maritime) economic zone and coordinates the security and defense sector. The system of subjects of the security and defense sector, which are entrusted with the functions of ensuring security and protection of the state border of Ukraine, is analyzed. It is established that, despite the problems of organizational support of the management system in the field of security and protection of the state border, regulatory and legal support of security and defense entities entrusted with security and protection of the state border of Ukraine remains at the appropriate level and has a steady trend towards further improvement.
