Формування правового й організаційного механізмів публічного управління у сфері національної безпеки в Україні в умовах воєнного періоду

Abstract

У статті визначено особливості та тенденції розвитку правового й організаційного механізмів публічного управління у сфері національної безпеки в Україні в умовах воєнного періоду. Підгрунтя для визначення цих тенденцій становить чинна нормативно-правова база у сфері підтримки національної безпеки, у тому числі інституційної підтримки (органів державної влади, громадськості та інших публічних інституцій). Серед цих тенденцій, насамперед, окреслені такі: 1) удосконалення Стратегії національної безпеки України (2020 р.), адже вона є одним з основних організаційно-правових засобів публічного управління в досліджуваній сфері та має відповідати вимогам часу та суспільства, що змінилися через зовнішню агресію проти України; 2) упровадження системного підходу до формування та реалізації організаційного й правового механізмів публічного управління у сфері національної безпеки в Україні; 3) забезпечення стратегічності та довгостроковості планування в цій сфері. Констатовано, що в загальному контексті одним із пріоритетних завдань організаційного та правового механізмів публічного управління у сфері національної безпеки в Україні є налагодження дієвої інституційної взаємодії за будь яких умов. It is stated that the state of national security in Ukraine at the present stage requires the formation of new trends towards the formation of its own security system. Of course, for the whole world, this process will also have certain consequences (both positive and negative) for the entire collective security system. Realizing that it is important to ensure the manifestation of positive consequences, some countries provide some assistance to Ukraine. However, it is worth remembering that it is necessary to implement a set of organizational and legal measures aimed at ensuring their own security in the long run. Since 2020, Ukraine has a strategic legal document in this area, entitled: "Human security — national security". This document is designed to ensure the social orientation of public policy. It is enough to look at its preamble, which recognizes the need to develop and adopt a number of strategies in the field of human capital conservation in Ukraine, the formation of its information and other security. Given the importance of ensuring its proper level within the legal field, we will consider in more detail the features of the formation of legal and organizational mechanisms of public administration in the field of national security. The article identifies features and trends in the development of legal and organizational mechanisms of public administration in the field of national security in Ukraine during the war. The basis for identifying these trends is the current regulatory framework in the field of national security support, including institutional support (public authorities, the public and other public institutions). Among these trends, first of all, the following are outlined: 1) improvement of the National Security Strategy of Ukraine (2020), as it is one of the main organizational and legal tools of public administration in the study area and must meet the requirements of time and society. against Ukraine; 2) introduction of a systematic approach to the formation and implementation of organizational and legal mechanisms of public administration in the field of national security in Ukraine; 3) ensuring strategic and long-term planning in this area. It is stated that in the general context one of the priority tasks of organizational and legal mechanisms of public administration in the field of national security in Ukraine is to establish effective institutional cooperation under any circumstances.
