Нормативно-правове регулювання реалізації цивільно-військового співробітництва в Україні

Abstract

У статті проаналізовано нормативно-правові документи з цивільно-військового співробітництва в Україні. Використано порівняльний та контент-аналізи нормативно-правових документів України та документів Організації Об'єднаних Націй, Північноатлантичного альянсу та провідних країн світу при їх застосуванні у міжнародних операціях з підтримання миру і безпеки, у ліквідації надзвичайних ситуацій техногенного та природного характеру, гуманітарних операціях з метою формування теоретичної основи для удосконалення нормативно-правової бази України в згаданій сфері в умовах відбиття зовнішньої збройної агресії з боку Російської Федерації. Визначено, що Цивільно-військове співробітництво є найбільш ефективним та результативним сегментом відносин між суспільством і збройними силами, а також між збройними силами і політичною владою, у зв'язку з чим є стандартною функцією збройних сил держав-членів НАТО, яка виконується їх органами військового управління, військовими частинами та підрозділами на тактичному, оперативному і стратегічному рівнях, як у місцях їх постійної дислокації, так і у операційних районах (зонах ведення бойових дій). This article analyzes the legal documents on civil-military cooperation in Ukraine. Comparative and content analyzes of normative and legal documents of Ukraine and documents of the UN, the NATO and leading countries of the world are used in their application in international peacekeeping and security operations, in man-made and natural emergencies, humanitarian operations to formation of a theoretical basis for improving the regulatory framework of Ukraine in this area in terms of repelling external armed aggression by the Russian Federation. Civil-military cooperation has been identified as the most effective and efficient segment of the relationship between society and the armed forces, as well as between the armed forces and political authorities, and is therefore a standard function of the armed forces of NATO member states, military units and subdivisions at the tactical, operational and strategic levels, both in their places of permanent deployment and in operational areas (combat zones). It is proposed to continue the study and implementation of the experience of the relevant structures of the UN, NATO, EU and leading countries in the world in order to form a modern domestic model of the CIMIC institution. Generalization and implementation of the experience of the CIMIC helps to increase the effectiveness of the CIMIC measures, to form a positive image of the Armed Forces of Ukraine, to reduce the training time of the CIMIC specialists and to acquire professional skills these specialists, expanding the arsenal of theoretical means of describing the application of the Armed Forces of Ukraine, State Emergency Service of Ukraine and other military formations of the state. During its existence, the CIMIC units of the world's leading countries have proven their effectiveness in their use in peacekeeping operations and gained unique experience, which certainly deserves attention in the process of reforming and developing the Armed Forces of Ukraine, during the training peacekeeping contingents, taking into account the course chosen by our country for Euro-Atlantic integration, strengthening the humanitarian component of the Armed Forces of Ukraine, improving the system of democratic civilian control over the Armed Forces of Ukraine.
