Транснаціональна злочинність і національна безпека: необхідність зміни безпекової парадигми України

Abstract

Досліджено основні загрози від Транснаціональної організованої злочинності (ТОЗ) для національної безпеки України в контексті здійснення нею протиправної діяльності. З'ясовано, що її кримінальні суб'єкти здатні справляти відчутний вплив на процес прийняття політичних рішень у системі державного управління. Означена структурна архітектура та визначена інструментальна конфігурація основних компонентів, завдяки яким може реалізовуватися транснаціональна злочинність. Визначені причини успішної функціональності Транснаціональних кримінальних акторів (ТКА) у контексті здійснення ними міжнародної протиправної діяльності. З'ясовано, що системне дотримання герметичності у сфері національної безпеки, гарантуватиме можливість безперервного економічного розвитку української держави на інноваційних засадах зі збереженням національного суверенітету в умовах наявності транснаціональних загроз. The article deals with the specifics of transnational crime as a global phenomenon that emerged within the global economy. Transnational crime is a consequence of not only the bureaucratized system of public administration, but also of the economic interdependence of countries due to the emergence of international trade, rapid spread of new technologies, development of international financial and payment systems, transformation of communication system, movement of human and intellectual capital and rapid escalation of military-economic confrontation between super powers. The research has shown that financially and technologically dominating transnational corporate groups, as well as super powers, skillfully use cyberspace to weaken national governments. The reason for the activity of transnational organized crime in Ukraine is the imperfection of current legislation. Transnational organized crime is the latest threat to Ukraine's sovereignty, as it has great destructive potential. The main components through which transnational organized crime can be realized are identified. Professionally using legal, financial, economic and political tools, possessing significant human resources, its criminal subjects are able to systematically increase their influence on the national economy and political elites of the state. This can pose a potential threat of the loss of political and power subjectivity by national elites and lead to the changes in the foreign affairs, national, educational and defense policy, and so on. The process of developing the new security paradigm is practically impossible without the formation of new, more adapted to modern transnational threats, security institutions, mechanisms and tools already used by technologically advanced Western countries, which modernize the security policy in this area, move to new, political, legal and force principles for overcoming this type of threat. Adherence to the principles of leak-proof and evolutionary development of the Ukrainian national security will guarantee the possibility of preserving the state sovereignty and continuous economic development.
