Стан та напрями удосконалення нормативно-правового регулювання управління комунальною власністю територіальних громад в Україні

Abstract

У статті розкрито основні етапи формування нормативно-правової бази сфери управління об'єктами комунальної власності територіальних громад в Україні. Встановлено особливості процесу безпосереднього формування майна комунальної власності територіальних громад в Україні та з'ясовано основні негативні фактори даного процесу. Проаналізовано ключові нормативно-правові акти сфери управління об'єктами комунальної власності територіальних громад, досліджено основні тенденції їх розвитку та виокремлено позитивні та негативні сторони, на основі чого запропоновано шляхи удосконалення. Виокремлено найбільш перспективні механізми управління комунальною власністю та проаналізовано ключові фактори, що унеможливлюють їх повне практичне застосування. На підставі проведеного грунтовного аналізу, надано практичні пропозиції з удосконалення законодавства щодо управління комунальною власністю територіальних громад в Україні. The article discloses the essence of the normative-legal regulation of the management of communal property of territorial communities, which consists in the establishment of legislative rules for such management, determines the grounds, methods and forms of activity of the relevant subjects in order to exert influence on the object of regulation to achieve a specific goal. The research of scientists on the issue of reforming local self-government, transformation of property under the influence of decentralization of power, stages of establishment and formation of communal property of territorial communities is analyzed. The regulatory and legal toolkit of territorial communities and their representative bodies, aimed at ensuring the effective implementation of their own powers in the field of proper property management, was studied. The point of reference for the revival of local self-government in Ukraine and the development of a legal framework for the management of objects of communal property of territorial communities has been established, which coincides with the immediate beginning of the process of its formation, which, unlike the common European experience, is a product of the demarcation of state-owned property of the Ukrainian SSR. A thorough analysis of the main legal acts in the field of management of objects of communal property of territorial communities in Ukraine has been carried out, the main stages of the evolution of mechanisms of regulation in this area have been highlighted, from the direct formation of property of territorial communities to the latest modern developments caused by active European integration processes and the implementation of European norms and practices and approaches. The most promising tools in the field of management of communal property objects have been singled out and the main barriers to their implementation have been identified, which, in our opinion, consist in the absence of stable political courses and a weak institution of the rule of law. Based on the results of the research, appropriate conclusions and proposals have been made aimed at improving the mechanisms of normative and legal regulation of the management of objects of communal property of territorial communities in Ukraine.
