Проблеми становлення державного управління інтелектуальною власністю в Україні

Abstract

Статтю присвячено аналізу становлення державного управління інтелектуальною власністю в Україні. Виявлено, узагальнено та надано характеристику етапів становлення системи державного управління інтелектуальною власністю за період незалежності України. Здійснено короткий аналіз нормативно-правової бази в сфері інтелектуальної власності в Україні. Проаналізовано систему та організаційну структуру державних органів, визначено їх основні повноваження на сучасному етапі. Визначено важливість спрямування державної політики на подальше удосконалення в сфері інтелектуальної власності. Вказано на необхідність забезпечення розвитку системи фінансового та податкового стимулювання інноваційної діяльності, посилення координації центральних органів виконавчої влади в частині комерціалізації об’єктів інтелектуальної власності та створення ефективної інфраструктури ринку інтелектуальної власності. Важливим завданням в цій сфері публічного адміністрування є забезпечення нормативно-правового розвитку франчайзингу, забезпечення інформаційної підтримки суб’єктів ринку об’єктів інтелектуальної власності та усунення прогалин в антимонопольному законодавстві України. У статті визначено основні проблеми, які потребують їх вирішення для можливості удосконалення державного управління інтелектуальною власністю в Україні. Автором запропоновано напрямки, розвиток яких, дозволить удосконалити механізми державного управління в сфері інтелектуальної власності в Україні та підвищити рівень інновацій.The article deals with the analysis of the formation of public administration of intellectual property in Ukraine. The author presents and generalized a description of stages of formation of the system of state management of intellectual property during the period of Ukraine’s independence. A brief analysis of the regulatory framework in the field of intellectual property in Ukraine was conducted. The system and organizational structure of state bodies are analyzed, their main competencies are defined at the present stage. The importance of direction of state policy for further improvement in the field of intellectual property is determined. The article provides indicated on the necessity of development of the system of financial and tax incentives for innovation activity, strengthening coordination of central executive authorities in terms of commercialization of intellectual property objects and the creation of an effective intellectual property market infrastructure. An important task in this area of public administration is to ensure the regulatory and legal development of franchising, to provide information support to the subjects of the market of intellectual property objects and to eliminate gaps in the antitrust laws of Ukraine. The article defines the main problems that need to be solved for the possibility of improving the state management of intellectual property. The author suggests directions, the development of which will improve the mechanisms of state management in the field of intellectual property in Ukraine and increase the level of innovation.
