Реалізація державних механізмів захисту національних цінностей в зарубіжних країнах (Сполучені Штати Америки, Велика Британія, Японія)

Abstract

Захист національних інтересів в державах поза межами ЄС має одну надзвичайно важливу відмінність – такі держави не мають необхідного політичного, інституційно оформленого механізму консолідації всіх без виключення ресурсів для вирішення такого завдання. Такі держави, поза межами ЄС, повинні створювати самостійно необхідний рівень ресурсного забезпечення, в тому числі політичного, для вирішення завдання захисту власних національних цінностей. У такому випадку виникає ситуація, за якої їх власної ресурсної бази стає недостатньо, що вимагає від таких держав пошуків додатковим зовнішніх джерел ресурсного забезпечення. Такий процес є циклічним, а тому формує нову глобальну реальність, коли захищаючи свої системи національних цінностей держави консолідують навколо себе або тотожні за етнокультурним складом, спільним історичним минулим держави; або шляхом прямої експансії та насадження власних ідеологем. У статті автори акцентують увагу на двох типах держав: перші, які реально захищають свої системи національних цінностей, й другі, які лише проголошують цінності своїх держав. До першого типу держав належить Співдружність націй (Commonwealth of Nations), яка об’єднує країни англосаксонської правової родини. До другого типу належать держави, яких об’єднує тоталітарний табір комуністичного режиму, що існував з 1923 по 1991 рік та мав своїм центром срср. Користуючись методом історизму та історико-правового аналізу автори зробилио цілком логічний та єдиний вірний висновок про ефективність підходів, покладених в основу існування кожної агломерації, союзу країн. Саме тому, головна увага в статті спрямовується на аналіз процесу реалізації державних механізмів захисту національних цінностей в країнах, що впроваджують, а не проголошують, демократичний шлях розвитку та систему громадянських прав і свобод, визнаючи людину найвищою цінністю держави, зокрема це Сполучені Штати Америки, Велика Британія, Японія. Авторами статті визначено застосування системного підходу реалізації державних механізмів захисту національних цінностей в зарубіжних країнах та визначені їх основні висновки для імплементації у вітчизняну практику функціонування державних механізмів захисту національних цінностей в Україні. The protection of national interests in states outside the EU has one extremely important difference - such states do not have the necessary political, institutionalized mechanism to consolidate all resources without exception to solve this problem. Such states outside the EU have to create the necessary level of resources, including political ones, on their own to solve the problem of protecting their own national values. In this case, a situation arises in which their own resource base becomes insufficient, which requires such states to seek additional external sources of resources. This process is cyclical, and therefore forms a new global reality, when, in defense of their systems of national values, states consolidate around them either states that are identical in ethnic and cultural composition, common historical past; or through direct expansion and imposition of their own ideologies. In the article, the authors emphasize two types of states: the first, which actually defend their systems of national values, and the second, which only proclaim the values of their states. The first type of states includes the Commonwealth of Nations, which unites the countries of the Anglo-Saxon legal family. The second type includes states united by the totalitarian camp of the communist regime that existed from 1923 to 1991 and had the USSR as its center. Using the method of historicism and historical and legal analysis, the authors have made a quite logical and only correct conclusion about the effectiveness of the approaches underlying the existence of each agglomeration and union of countries. That is why the article focuses on the analysis of the process of implementation of the State mechanisms for protection of national values in countries which implement, rather than proclaim, the democratic path of development and the system of civil rights and freedoms, recognizing a person as the highest value of the State, in particular, the United States of America, Great Britain, and Japan. The authors of the article determine the application of a systematic approach to the implementation of state mechanisms for the protection of national values in foreign countries and identify their main conclusions for implementation in the domestic practice of functioning of state mechanisms for the protection of national values in Ukraine.
