Міжнародно-правові основи розвитку прав національних меншин та запобігання міжнаціональних конфліктів

Abstract

У статті досліджено нормативно-правовий та інституційний інструментарій розв'язання міжнаціональних проблем, зокрема ООН та європейськими організаціями. З'ясовано, що ОБСЄ, починаючи з післявоєнних років, напрацьовано та зреалізовано низку документів, якими держави-учасниці гарантують кожній людині без будь-яких національних чи інших переваг, право на свободу самовираження, освіту, соціальні, економічні, культурні права тощо. До них віднесено: Загальну декларацію прав людини, Міжнародний пакт про цивільні й політичні права, Міжнародний пакт про економічні, соціальні та культурні права, Європейську конвенцію про захист прав людини та основних свобод, Міжнародну конвенцію про ліквідацію всіх форм расової дискримінації, Конвенцію про права дитини, Рамкову конвенцію про захист національних меншин, Декларацію про права осіб, що належать до національних чи етнічних, релігійних і мовних меншин тощо. Обгрунтовано, що Україна, як демократична правова держава, також несе юридичні зобов'язання з чималої низки міжнародних договорів, що передбачають гарантування прав національних меншин. The article analyzes the legal and institutional tools for solving international problems, in particular the UN and European organizations. It was found out that, since the post-war years, the OSCE has developed and implemented a number of documents by which the participating states guarantee every person, without any national or other advantages, the right to freedom of expression, education, social, economic, cultural rights, etc. These include: the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the International Convention on the Elimination of All Forms of Racial Discrimination, the Convention on the Rights of the Child, the Framework Convention on the Protection of National Minorities, the Declaration on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities, etc. It has been proven that the events related to the collapse of the USSR, Yugoslavia, Czechoslovakia, and the emergence of new independent states became a kind of catalyst for the modernization of international legal foundations for the prevention and settlement of inter-ethnic conflicts. It was in the 90s that the above-mentioned documents appeared. These documents and the practical actions regulated by them allow us to assert a certain reduction of threats and dangers of an ethnic nature in Ukraine, where the policy of tolerance is quite successfully implemented, the regulatory potential of which is based, on the one hand, on the requirements to say "yes" to every culture, any world of life, on the other — to reject any actions that speculate and manipulate national feelings. Ukraine was and remains a unique multi-ethnic state as a result of the uniqueness of its historical and cultural development, inter-ethnic relations, original patterns of national self-awareness of peoples. Therefore, the sphere of international relations is one of the most important for Ukraine. It is substantiated that Ukraine, as a democratic state governed by the rule of law, also bears legal obligations from a considerable number of international treaties that provide for the guarantee of the rights of national minorities.
