Статус учасника бойових дій в Україні: публічно-управлінський аспект

Abstract

У статті проаналізовано особливості надання статусу учасника бойових дій, правові засади його визначення, діяльність публічний інституцій щодо реалізації статусу учасника бойових дій, зокрема щодо забезпечення їх прав, гарантій. Зокрема, зазначено прогалини у Законі України "Про статус ветеранів війни, гарантії їх соціального захисту", проаналізовано актуальні зміни та перспективи застосування цього нормативно-правового акту щодо реалізації статусних характеристик учасників бойових дій. Проаналізовано діяльність публічних інституцій щодо необхідності визначення на законодавчому рівні та відзначення осіб, які брали безпосередню участь в здійсненні заходів необхідних для забезпечення оборони України, захисту безпеки населення та інтересів держави у зв'язку з військовою агресією Російської Федерації проти України. У статті розкрито публічно-управлінський вплив на процеси формування та реалізації статусу учасника бойових дій через здійснення державного управління, зокрема у сфері соціального захисту через органи загальної і спеціальної компетенції. Актуалізовано доцільність застосування програмного підходу до соціального захисту учасників бойових дій. Визначено переваги застосування програми, які виявляються через комплекс взаємопов'язаних завдань і заходів, що спрямовані на розв'язання найважливіших проблем соціального захисту, розподілу соціального захисту на окремі елементи, поділ за територіальною приналежністю, фінансування за рахунок Державного бюджету України, узгодження за строками виконання, складом виконавців, ресурсним забезпеченням. Аргументовано, що у сфері соціального захисту можна застосувати такі державні цільові програми: загальнодержавні програми соціального захисту; інші програми, метою яких є розв'язання окремих проблем соціального захисту окремих категорій учасників бойових дій, а також за територіальним критерієм; загальнодержавні програми соціального розвитку. Здійснено пропозицію щодо можливості застосування програм обласного значення, зокрема цільових програм підтримки учасників бойових дій. З цією метою було проаналізовано Обласну цільову програму підтримки учасників бойових дій, членів їх сімей та членів сімей загиблих (померлих) учасників антитерористичиої операції/операції об'єднаних сил на 2022—2026 роки Вінницької області. The article analyzes the features of granting the status of a combatant, the legal basis for its definition, the activities of public institutions for the implementation of the status of a combatants, in particular, to ensure their rights and guarantees. In particular, gaps in the Law of Ukraine "On the status of war veterans, guarantees of their social protection" were noted, current changes and prospects for the application of this regulatory legal act on the implementation of the status characteristics of combatants were analyzed. The activities of public institutions are analyzed regarding the need to determine at the legislative level and celebrate the persons who were directly involved in the implementation of measures necessary to ensure the defense of Ukraine, protect the security of the population and the interests of the state in connection with the military aggression of the Russian Federation against Ukraine. The article reveals the public-administrative influence on the processes of formation and implementation of the status of a combatants through the implementation of public administration, in particular, in the field of social protection through bodies of general and special competence. The expediency of applying a programmatic approach to the social protection of combatants has been updated. The advantages of the application of the program are determined, which are manifested through a set of interrelated tasks and measures aimed at solving the most important problems of social protection, the distribution of social protection into separate elements, division by territorial affiliation, financing from the State Budget of Ukraine, coordination in terms of implementation, composition of performers, resource provision. It is argued that the following state targeted programs can be applied in the field of social protection: nationwide programs of social protection; other programs, the purpose of which is to solve certain problems of social protection of certain categories of participants in hostilities, as well as according to the territorial criterion; nationwide social development programs A proposal has been made on the possibility of using programs of regional significance, in particular, targeted programs to support combatants. For this purpose, the Regional Target Program for Supporting Participants in Combat Operations, Their Families and Family Members of the Fallen (Deceased) Participants of the Anti-Terrorist Operation/Joint Forces Operation for 2022—2026 in Vinnytsia Oblast was analyzed.
