Види парламентського контролю за діяльністю Кабінету Міністрів України

Abstract

У статті здійснено аналіз теоретичних підходів до класифікації видів парламентського контролю, а також визначення основних форм його здійснення. На підставі аналізу наукових досліджень та нормативно-правових актів запропоновано узагальнену класифікацію видів парламентського контролю за діяльністю Уряду в Україні за такими класифікаційними ознаками: за суб'єктами та формою здійснення — прямий та опосередкований; за тематикою та характером дії — інформаційний, політичний, юридичний, соціальний; за видом інституту (організаційний рівень) — державний та громадський; за наслідками та процедурами — безсанкційні та такі, що призводять до накладання санкцій чи виплати штрафів; за особливостями відносин між суб- 'єктом і об'єктом контролю — внутрішній і зовнішній; за стадіями проведення — попередній, поточний, post-контроль, наступний. Автором зазначено, що запропонована класифікація видів парламентського контролю сприятиме виробленню більш уніфікованих підходів до їх здійснення, що в результаті дасть змогу забезпечити ретельніший та різноманітніший контроль за діяльністю виконавчої гілки державної влади. У статті також, на підставі аналізу чинного законодавства у сфері парламентського контролю за діяльністю Кабінету Міністрів України та виконавчої гілки влади в цілому, виокремлено такі його основні форми: "година запитань до Уряду", парламентські слухання, комітетські слухання, запити та звернення народних депутатів України. Також, обгрунтовано розподіл форм парламентського контролю за інформативним, санкціонуючим та бюджетно-фінансовим характером. The article analyzes theoretical approaches to the classification of the types of parliamentary control, as well as the definition of the main forms of its implementation. Based on the analysis of scientific research and legal acts, a generalized classification of the types of parliamentary control over the activities of the Government in Ukraine is proposed according to the following classification features: by subjects and implementation form — direct and indirect; by topic and nature of action — informational, political, legal, social; by type of institute (organizational level) — state and public; by consequences and procedures — without sanctions and such that lead to the imposition of sanctions or the payment of fines; according to the features of the relationship between the subject and the object, control is internal and external; according to the stages of implementation — previous, current, post-control, further.The author states that the proposed classification of types of the parliamentary control will contribute to the development of more unified approaches to their implementation, which will ultimately make it possible to ensure more careful and diverse control over the activities of the executive branch of the state power. Based on the analysis of the current legislation in the field of parliamentary control over the activities of the Cabinet of Ministers of Ukraine and the executive branch of government in general, the article also singles out its main forms: "question hour to the Government", parliamentary hearings, committee hearings, requests and appeals by the people's deputies of Ukraine. Also, the distribution of forms of the parliamentary control by informative, sanctioning, and budgetary and financial nature is substantiated. In order to determine the priority directions for improving the parliamentary control, in particular to its form such as requests and appeals by the people's deputies of Ukraine, it is proposed to standardize the following measures: to unify the requirements for the form of requests and questions specified in the Regulations of the Verkhovna Rada of Ukraine; to consider and write down the differences between written and oral questions of the People's deputies of Ukraine; to consider the issues related to the regulation of their registration procedure, etc. The prospect of the further scientific research in this direction it was established the expediency of defining and analyzing the main subjects of the parliamentary control over the activities of the Government of Ukraine.
