Основні форми забезпечення безпеки особистості на стадії соціальної трансформації та реформування

Abstract

У статті визначено основні форми забезпечення безпеки особистості та визначено вплив на стан національної безпеки держави. Варто зазначити, що подальші результати інтеграції України до європейських співтовариств безпосередньо залежить від ефективного механізму конституційно-правового забезпечення, відповідного напряму правової політики не тільки в зовнішньодержавному, а й внутрішньодержавному правопорядку. Однією з важливіших умов існування та розвитку особистості є забезпечення її безпеки. Стан безпеки особистості є важливішим критерієм демократичності та цивілізованого суспільства. Це безпосередньо відноситься до нашого суспільства, яке знаходиться на стадії соціальної трансформації та реформування. Численні факти злочинних зазіхань на життя і здоров'я громадян України потребують теоретичного аналізу і детальної розробки обгрунтованих науково-практичних рекомендацій щодо забезпечення безпеки особистості. Між іншим, проблема ця у сучасній спеціальній літературі практично не представлена, що зумовлює необхідність у визначенні та висвітленні її базових понять. При цьому проблема конституційного забезпечення стає фундаментальною та системною, з точки зору конституційності, набуває системно-функціонального значення. Права і свободи людини та їх гарантії визначають зміст і спрямованість діяльності держави. Держава відповідає перед людиною за свою діяльність. Утвердження і забезпечення прав і свобод людини є головним обов'язком держави. З огляду на викладене, від рівня гарантування безпеки особистості, недопущення порушень та гарантування державою прав, свобод і законних інтересів людини залежить і рівень самої національної безпеки. Отже від рівня гарантування безпеки особистості, недопущення порушень та гарантування державою прав, свобод і законних інтересів людини залежить і рівень самої національної безпеки. The article defines the main forms of ensuring personal security and determines the impact on the state of national security of the state. It is worth noting that the further results of Ukraine's integration into the European communities directly depend on the effective mechanism of constitutional and legal support, the appropriate direction of legal policy not only in the foreign, but also in the domestic legal order. One of the most important conditions for the existence and development of an individual is ensuring his safety. The state of personal security is a more important criterion of democracy and civilized society. This directly applies to our society, which is at the stage of social transformation and reformation. Numerous facts of criminal encroachments on the life and health of Ukrainian citizens require theoretical analysis and detailed development of substantiated scientific and practical recommendations for ensuring personal safety. By the way, this problem is practically not presented in modern special literature, which makes it necessary to define and highlight its basic concepts. At the same time, the problem of constitutional provision becomes fundamental and systemic, from the point of view of constitutionality, acquires systemic and functional significance. Human rights and freedoms and their guarantees determine the content and direction of state activity. The state is responsible to the people for its activities. Affirmation and provision of human rights and freedoms is the main duty of the state. In view of the above, the level of national security itself depends on the level of guarantee of personal safety, prevention of violations and the state's guarantee of human rights, freedoms and legitimate interests. Increasing the importance of security as a global value of humanity, preserved by the importance of such a component of it as humanitarian security, the main object of which is the individual, as an intellectual, spiritual, ethical potential. A person is a part and at the same time the basis of any society and state. Any state should be interested in the development of each of its citizens, in their security and personal goals. The personality increasingly becomes a hostage of the negative consequences of both economic, socio-political, scientific and technical and other technologies of social development. Means of transformation of social life, in which it acts as a secondary object of attention and interaction, or the subject of regular social experiments and manipulations. Therefore, the level of national security itself depends on the level of guaranteeing the safety of the individual, preventing violations and guaranteeing the rights, freedoms and legitimate interests of a person by the state.
