Аналіз правового механізму забезпечення фінансової безпеки як інструменту публічної політики

Abstract

Метою статті є дослідження питання публічної політики у контексті її впливу на забезпечення фінансової безпеки України через правовий механізм та пошук шляхів вирішення проблеми її забезпечення шляхом впровадження ефективних управлінських рішень, що базуються на правових нормах. Розглянуто існуючі в наукових колах різні трактовки поняття публічної політики, та обгрунтовано думку, що будь-яка діяльність представників публічної влади повинна бути спрямована на досягнення цілей, що безумовно будуть приводити країну до певної, зважаючи на внутрішні й зовнішні обставини, соціальної стабільності та сталого розвитку. Ці критерії (цілі) базуються на відповідних показниках, не останнім із яких є безпека. Акцентовано увагу на тому, що публічна політика розпочинається з процесу правотворчості, а правовий механізм урегульовує взаємовідносини між владою та іншими суб'єктами на усіх рівнях державного управління, відповідно, і фінансова безпека досягається шляхом належних взаємовідносин між усіма суб'єктами її забезпечення. Надано авторське визначення публічної політики забезпечення фінансової безпеки як цілеспрямованих заходів органів публічної влади та інститутів громадянського суспільства, спрямованих на вчасне виявлення реальних та потенційних загроз, мінімізацію ризиків або ліквідацію наслідків від їх настання, шляхом використання механізмів публічного управління, направлених на досягнення такого стану фінансової системи держави, що характеризується наявністю необхідних умов, які створюють фундамент для збереження цілісності та єдності фінансової системи країни та забезпечують її стабільний соціально-економічний розвиток. Обгрунтовано думку, що держава шляхом запровадження дієвих механізмів, у тому числі правового, повинна створити ситуацію законодавчої захищеності суб'єктів забезпечення фінансової безпеки, сформувати сприятливе нормативно-правове поле для діяльності створюваних ними об'єктів та забезпечувати їх безпеку на всіх рівнях взаємодії. Проаналізовано чинники, що впливають на ефективне забезпечення фінансової безпеки на рівні держави. Запропоновано заходи, спрямовані на посилення правового механізму публічної політики при забезпеченні фінансової безпеки держави. The purpose of the article is to study the question of public policy in the context of its impact on ensuring the financial security of Ukraine through a legal mechanism and to find ways to solve the problem of ensuring it by implementing effective management decisions based on legal norms. Various interpretations of the concept of public policy existing in scientific circles are studied, and the opinion is substantiated that any activity of representatives of public authorities should be aimed at achieving goals that will definitely lead the country to a certain, social stability and sustainable development, taking into account internal and external circumstances. These criteria (goals) are based on appropriate indicators, not the least of which is security. Attention is focused on the fact that public policy begins with the law-making process, and the legal mechanism regulates relations between the authorities and other subjects at all levels of state administration, respectively, and financial security is achieved through proper relations between all subjects of its provision. The author's definition of the public policy of ensuring financial security as targeted measures of public authorities and institutions of civil society, aimed at the timely identification of real and potential threats, minimizing risks or eliminating the consequences of their occurrence, through the use of public management mechanisms aimed at achieving such a condition of the financial system of the state, which is characterized by the presence of the necessary conditions that create a foundation for preserving the integrity and unity of the country's financial system and ensure its stable social and economic development is provided. The opinion is substantiated that the state, through the introduction of effective mechanisms, including legal ones, should create a situation of legal protection of entities that provide financial security, to form a favorable regulatory and legal field for the activities of the objects created by them and to ensure their security at all levels of interaction. The factors affecting the effective provision of financial security at the state level are analyzed. Measures aimed at strengthening the legal mechanism of public policy while ensuring the financial security of the state are proposed.
