Роль слідчого судді в процесі реалізації принципів кримінального провадження

Abstract

У пропонованій монографії на підставі системного аналізу чинного міжнародного та національного законодавства вперше в кримінальній процесуальній науці розглянуті питання загальних та спеціальних принципів кримінального провадження, процесуального статусу та повноважень слідчого судді та проблем реалізації принципів кримінального процесу слідчим суддею. Особливої уваги приділено дослідженню зарубіжного досвіду здійснення судового контролю слідчим суддею та напрямкам удосконалення процесуального законодавства щодо механізму реалізації слідчим суддею принципів кримінального провадження. Монографія розрахована на наукових співробітників, викладачів юридичних закладів вищої освіти і факультетів працівників правоохоронних і судових органів, адвокатів, студентів та аспірантів юридичних закладів вищої освіти. In the proposed monograph, on the basis of a systematic analysis of current international and national legislation, for the first time in criminal procedural science, issues of general and special principles of criminal proceedings, procedural status and powers of the investigating judge and problems of implementation of the principles of criminal proceedings by the investigating judge are considered. Special attention is paid to the study of the foreign experience of judicial control by the investigating judge and directions for improving the procedural legislation regarding the mechanism of implementation of the principles of criminal proceedings by the investigating judge. The monograph is intended for researchers, teachers of legal institutions of higher education and faculties of law enforcement and judicial bodies, lawyers, students and postgraduates of legal institutions of higher education.
