Запровадження інституту префекта в Україні: сучасний стан та тенденції розвитку

Abstract

У статті з'ясовано особливості та ключові завдання інституту префекта в умовах проведення реформи децентралізації влади в сучасній Україні. У статті викладено погляди на запровадження інституту префекта та певні особливості практичного іноземного досвіду його існування на прикладі таких країн, як Франція, Італія, Німеччина.Наголошення зроблено на вивченні основної ролі префекта та етапів його запровадження в Україні, що пропонуються існуючими законопроєктами.Зазначено, що важливим принципом діяльності інституту префекта є нагляд за законністю ухвалених рішень і попереджання можливих їх негативних наслідків. Слідкувати за дотриманням місцевими органами влади норм Конституції, виконанням ними законодавства України. Проаналізовано, що основні засади створення інституту префектів та реформування системи адміністративно-територіального устрою в Україні передбачені в проєкті Закону "Про внесення змін до Конституції України (щодо децентралізації влади)" (№ 2598 від 13.12.2019 року, внесений до Верховної Ради Президентом України) [4]. Обгрунтовано думку про те, що інститут префекта — це представництво влади, яке задає стратегічний напрям і має функцію нагляду. Територіальна громада вибирає своїх представників, які самі створюють ради, які потім сформулюють виконавчий комітет, а сам префект виконує функцію контролю та нагляду, щоб все виконувалось у рамках стратегії розвитку держави. The article clarifies the features and key tasks of the institution of the prefect in the context of thereform of decentralization of power in modern Ukraine. The article presents views on the introduction of the institution of prefect and certain features of practical foreign experience of its existence on the example of countries such as France, Italy, Germany. Emphasis is placed on the study of the main role of the prefect and the stages of its implementation in Ukraine, which are proposed by existing bills. It is noted that an important principle of the prefect's institution is to monitor the legality of decisions and prevent their possible negative consequences. Monitor the observance by local authorities of the norms of the Constitution and their implementation of the legislation of Ukraine. It is analyzed that the main principles of creating the institute of prefects and reforming the system of administrative-territorial organization in Ukraine are provided in the draft Law "On Amendments to the Constitution of Ukraine (on decentralization of power)" (№ 2598 of 13.12.2019, submitted to the Verkhovna Rada by the President of Ukraine) [4]. The opinion that the institution of the prefect is a representative office of the government, which sets the strategic direction and has a supervisory function, is substantiated. The territorial community elects its representatives, who create the councils themselves, which then formulate the executive committee, and the prefect himself performs the function of control and supervision, so that everything is done within the framework of the state development strategy.
