Модель правового механізму державного управління системою військової освіти

Abstract

У статті проведено аналіз та узагальнено результати впроваджених та запланованих змін у нормативно-правові акти Міністерства оборони України, що супроводжують розвиток системи військової освіти. Окреслено подальші зміни у нормативно-правові акти Міністерства оборони України та державних органів сектору безпеки і оборони, які здійснюють підготовку військових кадрів в інтересах сил оборони. Обгрунтовано, що правовий механізм державного управління системою військової освіти доцільно сформувати за ієрархічною моделлю на трьох рівнях. Підкреслено, що правовий механізм держаного управління системою військової освіти включатиме прямий (з гори до низу) та зворотній (з низу до гори) зв'язки, які забезпечують впровадження змін та управління змінами. Розроблено трирівневу ієрархічну модель правового механізму державного управління системою військової освіти. Сформульовано поняття "правовий механізм держаного управління системою військової освіти". Акцентовано увагу, що правовий механізм державного управління системою військової освіти є елементом спроможності системи — "доктрини" методу оборонного планування DOTMLPFI. The article analyzes and summarizes changes in regulations of the Ministry of Defence of Ukraine for the development of the military education system. The main changes include the following: candidates' age restrictions reduction for higher military educational institutions from 21… 23 to 30 years; determining the procedure for admission to military educational institutions of various categories of candidates based on the results of the external independent evaluation or entrance exams; establishing new requirements for information resources and logistics, organization of distance learning, methodological activities, and training of scientific and pedagogical staff; determining of the procedure principles for tactical level officers' training in military educational institutions and sergeants in institutions of professional higher military education; introduction of officers' training basics and professional military training programs based on a "bachelor's" degree obtained in civilian educational institutions; determining of the principles of training sergeants in educational and professional programs of higher education "junior bachelor" or educational and professional degree "professional junior bachelor"; introduction of a new system of "professional military education" courses that are compatible with similar courses in the armed forces of NATO member states. The author outlines further changes in the regulations of the Ministry of Defense of Ukraine and state bodies of the security and defense sector, which train military personnel in the interests of the defense forces. The article substantiates that the legal mechanism of state management of the military education system should be formed according to a hierarchical model at three levels. It was emphasized that the legal mechanism of state management of the military education system will include direct (from the top to the bottom) and indirect (from the bottom to the top) communication that ensure the changes implementation of and changes management The author has developed a three-level hierarchical model of the legal mechanism of state management of the military education system. The author developed the concept of "legal mechanism of state management of the military education system". It is emphasized that the legal mechanism of state management of the military education system is an element of the system's capacity namely the "Doctrine" of the DOTMLPFI defense planning method.
